Terms of Service

1. Who we are
DocksBase is operated by David Sajosi, sole proprietor (Einzelfirma) established in Switzerland ("DocksBase", "we", "us"). Contact: david.sajosi@gmail.com. DocksBase provides marina management and booking software, including
a berth map, reservations, invoicing and an integrated payment layer.

2. The agreement
These Terms govern your access to and use of the DocksBase software and services
(the "Service"). By creating an account or using the Service you agree to these
Terms. If you use the Service on behalf of a marina or other organisation, you
confirm you are authorised to bind that organisation.

3. Accounts
You are responsible for the accuracy of the information in your account and for
keeping your credentials secure. You must notify us promptly of any unauthorised
use of your account.

4. Subscriptions, fees and billing
The Service is provided on a subscription basis. Fees, billing frequency and any
applicable transaction fees are those shown at sign-up or otherwise agreed in
writing. Payments are processed by our payment provider, Stripe. Unless stated
otherwise, fees are exclusive of VAT and other applicable taxes. Subscriptions
renew for successive periods until cancelled; you may cancel at any time with
effect from the end of the current billing period.

5. Your data and your customers' data
You retain all rights in the data you and your boaters submit to the Service
("Customer Data"). You are the controller of personal data relating to your
boaters and staff; we process it on your behalf as described in our Privacy
Policy and Data Processing Agreement. You are responsible for having a lawful
basis to provide that data to us.

6. Acceptable use
You agree not to misuse the Service, including by attempting to gain unauthorised
access, interfering with its operation, or using it to store or transmit unlawful
content.

7. Availability
We work to keep the Service available and reliable but provide it "as is" and
"as available". During pilot and early-access phases in particular, the Service
may be subject to interruptions, changes and limited support.

8. Limitation of liability
To the extent permitted by law, neither party is liable for indirect or
consequential loss. Our total aggregate liability arising out of or in connection
with the Service is limited to the fees you paid for the Service in the twelve
months preceding the event giving rise to the claim.

9. Term and termination
These Terms apply for as long as you use the Service. Either party may terminate
for material breach not remedied within a reasonable period. We may suspend access
where necessary to protect the Service or comply with law. Fees accrued before
termination remain payable.

10. Changes
We may update these Terms from time to time. Material changes will be notified
through the Service or by email. Continued use after changes take effect
constitutes acceptance.

11. Governing law
These Terms are governed by the laws of Switzerland, and the courts of the place
of DocksBase's registered seat have jurisdiction, subject to any mandatory consumer
protections that apply to you.
